By accessing or using PushWave ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access the Service.
We reserve the right to update these Terms at any time. We will notify registered users of material changes via email or dashboard notification. Continued use after changes constitutes acceptance.
To use PushWave, you must register for an account. You agree to:
You must be at least 18 years old to create an account. By registering, you represent that you meet this requirement.
PushWave provides a web push notification platform that allows you to collect browser push subscribers from your website and send them targeted notifications. You may use the Service only for lawful purposes and in accordance with these Terms.
You are solely responsible for obtaining valid, informed consent from your website visitors before collecting push subscriptions. You must provide clear notice about what types of notifications subscribers will receive and honor unsubscribe requests promptly.
All notifications you send must comply with applicable laws. You must not send misleading, deceptive, or fraudulent content. Notifications must clearly identify your brand as the sender.

Violation of these prohibitions may result in immediate account termination without refund.
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law, or under our 14-day money-back guarantee for first-time subscribers.
We offer a 14-day money-back guarantee on all paid plans. If you are unsatisfied within the first 14 days, contact us at billing@pushwave.io for a full refund.
Upgrades take effect immediately and are prorated. Downgrades take effect at the end of the current billing cycle. Cancellations stop future charges; you retain access until the billing period ends.
Your use of the Service is also governed by our Privacy Policy and, for EU/EEA users, our GDPR Policy. You remain the data controller for your subscribers' data; PushWave acts as a data processor on your behalf.
PushWave and all related technology, software, and content are the exclusive property of PushWave and its licensors. These Terms do not grant you any right to use our trademarks, logos, or other brand elements without prior written consent.
You retain all rights to your own content and subscriber data. By using the Service, you grant PushWave a limited license to process your data solely to deliver the Service.
You may cancel your account at any time from the billing settings in your dashboard. We may suspend or terminate your account immediately if we determine, in our sole discretion, that you have violated these Terms.
Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination, after which it will be permanently deleted.
To the maximum extent permitted by applicable law, PushWave shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising from your use of the Service.
Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
The Service is provided "as is" without warranty of any kind. We do not guarantee 100% uptime, though we target 99.9% availability.
